In its future dealings with the Grievants, Management will comply with ELM 546.142, as agreed to by the parties in the National Pre-Arbitration settlement dated June 18, 2009, case # QOIN–4-Q~C 07190177, Union M1706. The parties agree that the two the Grievants will be made whole for all lost wages and benefits, including lost accrual of annual leave, sick leave, and Thrift Savings Plan funds had management provided carrier Duesler with 4 hours of work per day and carrier LaPointe with 6 hours work per day work from 2/23/12 to present. To the extent that the Grievant has already been compensated with OWCP benefits, Adminstrative Leave, or other forms of monetary reimbursement, these amounts will be applied as an offset to such remedy. The matter shall be remanded to the parties at Formal Step A, where final calculation of these hours and implementation of payment to the Grievants shall be effected. By virtue of this full and final settlement agreement, this document shall serve as the Union’s official notification to Management that this agreement represents full and complete settlement of the above stated grievance. Additionally, both parties agree that this settlement is non-precedent setting and will not be cited by either party in any subsequent grievance, arbitration hearing, or any other forum including EEO and MSPB other than to enforce the terms of this agreement.
